Should Client Sign Payment Agreement?

My Client caused a accident, causing the other party's car to be damaged to an amount of R20 000. At the time of accident, my client was under the influence of liquor and was afraid that if charged and found guilty in a court of law he might be sent to jail as he had a previous conviction for the same offense.
It so happened that the other party knew about my client's previous conviction and decided not to claim for his insurance. In view of the fact that he might loose his non-claim bonus in such that he forced my client to sign an agreement whereby the damages of R20 000 were to be repaid in installments failing which he would pursue criminal charges against my client.
Please advise whether my client should sign the agreement or not and what would be in his best interest to do?
